Boating Under the Influence in King County
Seattle is surrounded by water.  Whether it's boating on Lake Washington or Lake Union or fishing in the Puget Sound, one of the great things about living in King County is the abundance of water recreation that is available. It is one of the wonderful things about living in Western Washington.

In recent years, however, there has been an increasing emphasis and crackdown on drinking and boating throughout King County.  Law enforcement will often make contact with your vessel for a seemingly trivial or insignificant reason. 

The alleged violation is often nothing more than a pretext after alcohol was seen on the boat.  The next thing you know, a King County Sheriff or Washington State Trooper is asking you to perform field sobriety tests and requesting a breath sample.

These field sobriety tests are NOT mandatory.  You should politely but firmly refuse to take them.  You should also immediately request to speak with an attorney.  In general, the same is true for a requested breath test.  Unlike in the context of an arrest for DUI, there is no risk of having your driving privilege's suspended.  In most situations, it is simply in your best interests to refuse the breath test as well.



Boating Under the Influence is a Serious Criminal Offense here in Seattle and throughout King County.
Many of our clients are shocked when their day on Lake Washington watching the hydro races turns into an embarrassing and unforeseen criminal arrest.  A lot of people seem to be under the impression that BUI is nothing more than the equivalent of a speeding ticket.

The simple truth, however, is that Boating Under the Influence of Intoxicants, also known as BUI, is a serious criminal offense in Washington State.  It is a misdemeanor that is punishable by up to 90 days in jail and a $1,000 fine.  And, as noted above, it has been receiving a lot more attention from local law enforcement recently.

This is particularly true during the summer months and especially true on spring and summer holidays, as well as at special events such as SeaFair.  There are literally dozens and dozens of BUI arrests at SeaFair every year.  And, you can be charged with and convicted of BUI even if your BAC is below .08.
